1. Acceptance of Terms

Welcome to BetterGather, a community management platform for non-profit organizations operated by Better Process Group LLC ("we," "us," or "our"). By accessing or using BetterGather (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you (whether personally or on behalf of an organization) and Better Process Group LLC. You represent that you are at least 18 years old and that you have the authority to bind yourself or your organization to these Terms.

2. Description of Service

BetterGather is an all-in-one platform for non-profit and community organizations that provides:

  • Event and program management, including scheduling and calendars
  • Volunteer coordination, rostering, role assignment, and RSVP tracking
  • Membership and contact management (CRM), including groups and pipelines
  • Donor management, fundraising campaigns, and grant tracking
  • Communications tools, including email and SMS notifications
  • Document, photo, and video management
  • Learning management (LMS) for training and volunteer development
  • Dashboards, impact reporting, and analytics
  • Integration with Microsoft 365 / Outlook calendars and other third-party services
  • Mobile-friendly access for staff, volunteers, and members

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

The Service is offered to organizations operating in the United States. By using the Service, you represent that your organization uses BetterGather for lawful U.S. operations.

3. Account Registration

3.1 Account Creation

To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep that information up to date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

  • Use a strong password and keep it confidential
  • Notify us immediately of any unauthorized use of your account
  • Not share your account with others
  • Sign out of your account at the end of each session on shared devices

We will not be liable for any loss or damage arising from your failure to comply with this section.

3.3 Roles and Permissions

Organization administrators are responsible for managing user roles and permissions within their organization, including who can view member, donor, and minor-related records. Administrators must ensure that each user has an access level appropriate to their role.

3.4 Records About Other People

Your organization will use the Service to store records about members, volunteers, donors, and program participants — including, in some organizations, minors. You are responsible for having a lawful basis to collect and store that information, for obtaining any consents your programs require (including parental or guardian consent where applicable), and for honoring requests from those individuals. See Section 8 and our Privacy Policy.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable local, state, national, or international law
  • Transmit any material that is defamatory, harassing, offensive, or otherwise objectionable
  • Impersonate any person or entity or misrepresent your affiliation with an organization
  • Attempt to gain unauthorized access to any portion of the Service or related systems
  • Access, export, or use records belonging to another organization on the platform
  • Use the Service to send spam, chain messages, or unsolicited commercial communications
  • Solicit donations under false pretenses or on behalf of an organization you do not represent
  • Upload or transmit viruses, malware, or other malicious code
  • Interfere with or disrupt the Service or the servers and networks connected to it
  • Scrape, crawl, or use automated means to access the Service without our permission
  • Reverse engineer, decompile, or disassemble any portion of the Service

We reserve the right to investigate and take appropriate legal action against anyone who violates this policy.

5. Member Communications and Consent

BetterGather lets your organization send email and SMS/text messages to members, volunteers, and donors. You are the sender of those messages; we provide the tooling that delivers them.

You are solely responsible for complying with all laws that apply to those communications, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and applicable state law. In particular, you agree to:

  • Obtain and maintain appropriate consent before texting or emailing an individual
  • Honor opt-out and unsubscribe requests promptly
  • Not send messages to numbers or addresses obtained without permission
  • Not use the Service for political, commercial, or third-party marketing campaigns unrelated to your organization

Message and data rates may apply to recipients. We may suspend messaging features for an organization that generates excessive complaints, opt-outs, or carrier violations.

6. Subscription and Billing

6.1 Plans

BetterGather offers multiple plans, including a free tier. Each plan includes specific features and usage limits, as described on our pricing page and in your account settings.

6.2 Billing and Payment

Paid subscriptions are billed monthly or annually in advance. Payments are processed by Stripe; we do not store full payment card numbers. By providing payment information, you authorize us to charge your payment method for the selected plan. All fees are non-refundable except as required by law or as stated in our Refund Policy.

6.3 Free Plan and Trials

We may offer a free plan or a free trial period. Free plans may have reduced features and usage limits. If a trial converts to a paid plan, standard billing terms apply from the conversion date unless you cancel before the trial ends.

6.4 Automatic Renewal

Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date. We will charge the payment method on file for the renewal.

6.5 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you retain access to the Service until then.

6.6 Price Changes

We reserve the right to change our pricing. Price changes will not affect your current billing period but will apply on renewal. We will provide at least 30 days' notice of a price change.

6.7 Refunds and Promotional Credits

Refund eligibility, billing dispute timelines, and promotional credit terms are defined in our Refund Policy, which is incorporated into these Terms by reference.

7. Donations and Payment Processing

Where your organization enables online giving, BetterGather provides the tools to collect donations. Better Process Group LLC is not the recipient of those donations and is not a charitable organization, fundraiser, or fiscal sponsor. Donations are made to your organization, and your organization is solely responsible for:

  • The accuracy of any fundraising or campaign claims made through the Service
  • Issuing donation receipts and tax acknowledgments to donors
  • Determining the tax-deductibility of gifts and complying with charitable solicitation registration requirements in every state where you solicit
  • Resolving donor refund requests, disputes, and chargebacks

Donation payments are processed by Stripe and are subject to Stripe's terms and processing fees. We do not provide tax, accounting, or legal advice, and nothing in the Service should be interpreted as such advice.

8. Your Data and Privacy

8.1 Your Data

You retain all ownership rights to the data your organization submits to the Service ("Your Data"). By using the Service, you grant us a limited license to use, store, and process Your Data solely to provide the Service to you.

8.2 Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Service, you consent to our collection and use of information as described there.

8.3 Data Security

We implement reasonable security measures to protect Your Data. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

8.4 Data Backup and Recovery

We perform regular backups. You remain responsible for maintaining your own copies of Your Data, and we are not liable for data loss.

8.5 Multi-Tenancy

BetterGather is a multi-tenant platform. Your Data is logically isolated from other organizations' data and is only accessible to authorized users within your organization.

9. Intellectual Property

9.1 Our Rights

The Service, including all software, designs, text, graphics, logos, and other content, is owned by Better Process Group LLC and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted are reserved.

9.2 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your organization's internal purposes.

9.3 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback without any obligation to you.

9.4 Third-Party Services

The Service may integrate with third-party services (for example, Microsoft 365 and Stripe). Your use of those services is subject to their respective terms and conditions.

10. Termination

10.1 Termination by You

You may terminate your account at any time by canceling your subscription through account settings or by contacting us at support@bettergather.com.

10.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice, if you breach these Terms or engage in conduct we determine to be unlawful, abusive, or harmful to other users or the platform.

10.3 Effect of Termination

Upon termination, your right to use the Service immediately ceases. You may export Your Data within 30 days of termination. After 30 days, we may delete Your Data from our systems.

11. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • Defects in the Service will be corrected
  • The Service will meet your requirements

You use the Service at your own risk. We are not responsible for any decisions you make based on information provided by the Service.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTER PROCESS GROUP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DONATIONS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use of or inability to use the Service
  • Any unauthorized access to or use of our servers or any information stored on them
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or other harmful code transmitted through the Service
  • Any errors or omissions in content, or any loss or damage incurred as a result of content posted, emailed, texted, or otherwise made available through the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. Material changes will be communicated by email or through a prominent notice in the Service.

Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
